Cancellation of tax debts owed by confiscated companies: details

A ministerial decree published in the latest Journal Officiel sets out the procedures for cancelling the tax debts owed by companies confiscated by final court decision.

According to this text, signed by the Minister of Finance, the unpaid tax debts of the companies concerned - including simple duties, penalties, and associated tax sanctions - are now cancelled. This measure implies the complete cancellation of all sums due, whatever their nature.

In the event of partial confiscation of the property and assets of a natural or legal person, tax debts will be cancelled in proportion to the value of the assets seized.

The application of this provision is the responsibility of the directors of large companies or the wilaya tax directors, according to their respective prerogatives. The initiative for cancellation rests with the tax collector in charge of collection, based on the tax documents provided.

Finally, the Directorate General of Taxes is designated as the body responsible for implementing this decree.
