Government meeting: examination of draft executive decrees relating to Energy and Transport

"The Prime Minister, Mr. Abdelaziz Djerad, chaired, this Wednesday, February 17, 2021, a government meeting which took place by videoconference.

In accordance with the agenda, members of the government examined three (03) draft executive decrees presented by the ministers in charge of Energy and Transport.

In addition, one (01) communication was presented by the Minister of Fisheries and Fishery Products in his capacity as coordinator of the interministerial working group relating to administrative facilitations for economic recovery.


1- The government heard a statement presented by the Minister of Energy relating to two (02) projects of executive decrees fixing:

(i) - the methods of calculating the amounts of the monthly provisional payments equivalent to installments on the hydrocarbon income tax (IRH)

(ii) - the methods of calculating the provisional tax installments on the remuneration of the foreign co-contractor.


The first draft text provides an overview on the calculation of the tax on the income from hydrocarbons, with the emphasis on the down payments and by approaching, as an extension, the liquidation of the said tax.

In this context, the calculation parameters are processed to provide all the clarifications allowing a compliant application of the provisions of Law No. 19-13 governing hydrocarbon activities.

As for the second draft executive decree, it aims to determine the methods of calculating the provisional tax installments on the remuneration of the foreign co-contractor.

Indeed, the foreign co-contractor is liable to pay tax when it is party to a production sharing contract or a risky service contract.

As such, this draft executive decree aims to clarify the methods for calculating down payments and the related obligations in terms of declaration and payment.


2- The government heard a presentation by the Minister of Public Works, Acting Minister of Transport relating to the draft executive decree establishing a community port platform for the exchange of digital data.

The purpose of this draft executive decree is to set up a community port platform for the exchange of digital data "APCS", which enables our country to comply with the various commitments within the framework of the facilitation of international trade.

This community platform called "Algerian Port Community System" is also an electronic portal falling within the framework of the government program aimed at simplifying, facilitating and digitizing procedures for the benefit of economic operators.


3- The government heard a communication presented by the Minister of Fisheries and Fishery Products, in his capacity as coordinator of the interministerial working group relating to administrative facilitations for economic recovery.

With the objective of ensuring the transformation and development of the national economy by acting in particular on the aspect of the modernization and de-bureaucratization of its administrative environment, all economic and commercial activities subject to prior authorizations have been identified on the basis of four (04) criteria, namely:

1. The method of filing and issuing documents (counter or digital platform)

2. The number of documents constituting the file,

3. The time limit for processing and issuing documents,

4. Centralized or decentralized management of requests,


This assessment has also been extended to other institutions with prerogatives of public power.

At the end of this presentation, the Prime Minister instructed the ministers concerned to speed up the process of simplification initiated and to set up a focal point at the level of each ministerial department to monitor the implementation of the measures. taken within this framework and to ensure that the new texts proposed take charge of the concern for relief and facilitation as a priority axis of government action.

Finally, a detailed report will be presented to the Council of Ministers on the implementation of the process of simplifying and streamlining procedures for the benefit of citizens and economic and commercial entities ".
