The procedures for processing and issuing urban planning permits are undergoing changes.


Requests for building or demolition permits can now be submitted through a digital platform managed by the Ministry of the Interior and Local Communities, in addition to the establishment of single-window services at both the municipal and wilaya levels.


For construction projects where the work presents a risk to the immediate environment, the technical file must include a site stability study and a schedule of the various planned works.


The issuance of building or demolition permits now adheres to new conditions, which aim to provide better visibility through a digital platform and ensure the complete safety of constructions surrounding the site where the work is carried out.


The executive decree setting the procedures for processing and issuing urban planning permits has indeed been amended. The new version specifies that the submission of the urban planning permit application file can be done either in paper format or via the digital urban planning platform created by the Ministry of the Interior and Local Communities.


To obtain a building permit, applicants must submit not only an administrative file but also an architectural file and a technical file, in addition to a vulnerability assessment report of the site, completed by the architect and civil engineer who prepared the building permit file.


For construction projects that pose a risk to the immediate environment, the technical file must include a stability study of the site, surrounding constructions, and neighboring infrastructure, based on a soil study. This study must be validated by the national technical control agency.


The decree now requires those commencing construction work to provide a description of the methodology for excavation and construction work, along with a schedule for the various phases of the work. The issuance of building permits falls under the competence of the Minister of Housing and Urbanism for industrial and tourist investment projects, as well as public or private facilities of national interest; such as production, transportation, distribution, and storage of energy and water facilities located across two or more wilayas.


On the other hand, the issuance of building permits is the responsibility of the wali (governor) for industrial, tourist, and public or private facilities of local interest due to their nature, size, and scale, as well as for collective or individual housing projects of more than 200 units. Depending on the size and nature of the project, the processing of files is carried out either at the single-window service of the wilaya or the municipality, which may consult any person, authority, or organization to assist in their work.


The single-window service decides on the application after consulting and obtaining the agreement of the relevant sector services.


The decree specifies that no partial or total demolition of a building can be undertaken without first obtaining a demolition permit, taking into account risks to adjacent buildings and submitting a file including a vulnerability assessment report of the site. The technical file for demolition work that poses a risk to the immediate environment must also include a stability study of the site, surrounding constructions, and neighboring infrastructure, based on a soil study.

This study must be validated by the national technical control agency, along with a description of the methodology for implementing stability and environmental protection measures, and a schedule for the various phases of the work to end the perennial construction sites.
