Official Gazette: The Economic Land Law published

Signed on 15 November by President of the Republic, Abdelmadjid Tebboune, this law, No. 23-17, applies to economic land in the State-owned private property, consisting of developed land in industrial areas and business areas, developed land within the perimeter of new cities, developed land in expansion areas and tourist sites, developed land in technology parks, residual real estate assets of dissolved public enterprises, surplus real estate assets of economic public enterprises, land for commercial real estate development, other land are in the State-owned private property. 

The scope of the provisions of the law excludes agricultural land or land for agricultural purposes under the State-owned private property, land within mining areas, land within oil research and exploitation areas and perimeters for the protection of electrical and gas works. 

Lands under the State-owned private property intended to house areas of aquaculture activities, lands located within the perimeters of archeological sites and historical monuments, land intended for real estate development benefiting from State aid, land under the State-owned private property intended for the realization of public investment projects, are not also covered by this law. 

According to this new law, the Algerian Agency for the Promotion of Investment (AAPI) is responsible, through its one-stop shop, by delegation of the State, to decide, in consultation with the sectors concerned, on the orientation of land availability with a view to their development, to manage and promote the economic land portfolio of the State for the purpose of its concession, to maintain and update the file of economic land that can constitute the real estate offer intended for investment, and including the characteristics of each property, with the obligation to make available to investors all information relating to the real estate availability, through the digital platform of the investor. 

The AAPI is also responsible for acquiring on behalf of the State any private land that may receive an investment project, granting economic land in the private domain of the State to investors, by means of an OTC concession convertible into a sale, following and supporting investors until the realization of their investment projects, participating in the elaboration of urban planning instruments in order to express the investment needs. 

Thus, any natural or legal person, national or foreign, resident or non-resident, wishing to benefit from economic land in the private domain of the State, must register his application via the digital platform of the investor managed by the AAPI, which constitutes “the only and only way of filing”.
